Personal data processing policy

LCG New Media s.r.o., Business ID No. 059 50 660, with registered office at Pernerova 659/31a, Karlín, 186 00 Praha 8, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 273595 ("LCG"), protects all processed personal data as strictly confidential and handles them in accordance with applicable legal regulations in the field of personal data protection. The security of your personal data is a priority for LCG.

LCG is, within the meaning of the General Data Protection Regulation (Regulation (EU) 2016/679), the controller of your personal data, i.e. it collects, stores and uses (and otherwise processes) your personal data for the performance of its business activities (the individual purposes for which personal data are processed are defined in more detail below).

This personal data processing policy applies to (i) the processing of personal data by LCG during your use of this LCG website, (ii) the processing of personal data by LCG in the performance of contracts with business partners, (iii) the processing of personal data in the performance of LCG's legal obligations, and (iv) the processing of personal data that is necessary for the purposes of protecting LCG's legitimate interests.

The personal data processing policy describes the purposes of personal data processing and the methods of processing, informs about the individual categories of personal data processed, their potential recipients, the retention period of personal data and your rights in relation to the protection of personal data.

PURPOSES OF THE PROCESSING OF PERSONAL DATA

Your personal data may be processed by LCG for the following purposes:

  • Contract performance (in particular performance of cooperation agreements with business partners, service contracts, etc.);
  • Compliance with legal obligations (in particular obligations in the sense of accounting and tax legislation, i.e. the transfer of personal data to the financial administration authorities; possibly to other public authorities in accordance with the relevant legislation);
  • Legitimate interest of the controller (protecting the rights and legally protected interests of LCG, for example, assessing the creditworthiness of the customer);
  • Dealing with requests sent via electronic forms (in particular in the case of your interest in LGC employment, in the case of your request to receive newsletters or in the case of using the electronic form to contact LCG).

LCG is entitled to process the following personal data according to the purpose of processing:

Personal data is processed both manually and automatically at LCG. The automated processing of personal data occurs mainly for the purpose of fulfilling the contractual relationship.

PROCESSING OF PERSONAL DATA ON THE BASIS OF CONSENT

If you give LCG your consent to the processing of your personal data for the purpose of receiving LCG's newsletter, you acknowledge that the consent is voluntary and that you can withdraw your consent at any time in writing or via the link provided in the e-mail message. Consent is granted until revoked. Failure to give consent shall not affect the performance of the contract.

RECIPIENTS OF PERSONAL DATA

At LCG, your personal data is only disclosed to authorised employees or individual data processors contracted by LCG or other data controllers. However, only to the extent necessary for the fulfilment of the individual purposes of processing and on the basis of the corresponding legal title for the processing of personal data.

LCG is entitled, or obliged, to transfer certain personal data to law enforcement authorities or other public authorities in cases provided for by law.

PERSONAL DATA OF THIRD PARTIES

The personal data of third parties, which means the personal data of employees and customers of LCG's business partners and other individuals involved in cooperation with LCG, or other data received by LCG from a business partner in connection with the conclusion or performance of a contract, will be processed in accordance with applicable data protection legislation. LCG will use this personal data for the purpose of fulfilling contracts with business partners. The business partner hereby acknowledges that LCG will process the personal data of third parties for the duration of the contractual relationship and for the period of time provided for by special legal regulations, if any. They will then be kept for a longer period of time if there is a justified need to keep the data in relation to a specific case. The business partner is obliged to properly instruct its employees, customers and other natural persons involved in the business partner's cooperation with LCG on the processing of personal data by LCG.

RETENTION PERIOD OF PERSONAL DATA

We process and store your personal data for the period of time necessary to ensure all rights and obligations arising from the respective contractual relationship and for the period of time for which LCG, as the data controller, is obliged to store personal data under generally binding legal regulations or for which you have given us your consent to the processing. In other cases, the processing period is based on the purpose of the processing, which must be proportionate, or is determined by data protection legislation.

We process personal data according to the purpose of processing for the period of time specified here:

RIGHTS OF DATA SUBJECTS

As a data subject, you have the following rights under the law, which you can exercise at any time. This includes the right (i) to access personal data, (ii) to rectification of inaccurate or false personal data, (iii) to erasure of personal data if the personal data are no longer necessary for the purposes for which they were collected or otherwise processed or if it is established that they were processed unlawfully, (iv) to restriction of processing of personal data, (v) the portability of the data; and (vi) the right to object, after which the processing of your personal data will be terminated unless it is demonstrated that there are compelling legitimate grounds for the processing which override the interests or rights and freedoms of the data subject, in particular if the ground is the enforcement of legal claims. You also have the option of contacting the Office for Personal Data Protection (www.uoou.cz), with whom you can lodge a complaint.

  • Right of access to personal data: if you want to know whether LCG is processing personal data about you, you have the right to be informed whether your personal data is being processed and, if so, you also have the right to access your personal data. In the event of a repeat request, LCG will be entitled to charge a reasonable fee for a copy of the personal data provided. We will inform you of this procedure (the same applies to the exercise of the rights listed below).
  • Right to rectification of inaccurate and false personal data: if you believe that LCG is processing inaccurate or false personal data about you, you have the right to request its rectification. LCG will carry out the correction without undue delay, taking into account technical possibilities.
  • Right to erasure: if you request erasure, LCG will erase your personal data if (i) it is no longer necessary for the purposes for which it was collected or otherwise processed, (ii) the processing is unlawful, (iii) you object to the processing and there are no overriding legitimate grounds for the processing, or (iv) LCG is required to do so by law.
  • Right to restriction of processing of personal data: if you are not interested in erasure but only in temporary restriction of processing of your personal data, you can request LCG to restrict the processing of your personal data.
  • Right to data portability: if you want LCG to transfer your personal data to a third party, you can exercise your right to data portability. If the exercise of this right could adversely affect the rights and freedoms of third parties, LCG will not be able to comply with your request.
  • Right to object: you have the right to object to the processing of personal data that is processed for the performance of a task carried out in the public interest or in the exercise of official authority or for the protection of the legitimate interests of LCG. If LCG does not demonstrate that there is a compelling legitimate reason for the processing that overrides your interests or rights and freedoms, it will terminate the processing without undue delay based on your objection.
